For critical entities, recovery capacity must be designed from the perspective of functional priority. Which parts of the essential service must continue immediately, which data are necessary to enable safe resumption, which processes can be temporarily simplified, which dependencies must be restored first, and which decisions are required in order to move from emergency mode to stable operation in a controlled manner are not merely technical questions, but core questions of administrative responsibility.
For that reason, the design of digital redundancy and fallback arrangements must be closely connected with crisis governance, sectoral dependencies, and Integrated Financial Crime Risk Management. Recovery capacity becomes persuasive only when it is clear how the authenticity of data will be established during recovery, how fraudulent or manipulated instructions will be prevented during emergency operation, how external suppliers will be involved without loss of control, and how priority recovery will be aligned with the societal significance of the affected function. The art of digital resilience therefore lies in designing a recovery architecture that is both robust and manageable: sufficiently redundant to absorb failure, sufficiently simple to be activated under pressure, and sufficiently controllable to prevent the emergency solution itself from becoming a new source of disruption or loss of integrity.
The Relationship Between CER, the Wwke, NIS2, and Organization-Wide Digital Resilience
The relationship between the CER Directive, the Dutch Critical Entities Resilience Act, NIS2, and organization-wide digital resilience must be understood as a normative interrelationship in which different protective logics interact without merging into one another. The CER framework is primarily aimed at the resilience of critical entities against a broad spectrum of disruptions including natural hazards, sabotage, human error, malicious conduct, and other destabilizing events. NIS2 is directed more specifically at the security of network and information systems, and at the governance, notification obligations, and risk management required to bring cybersecurity in essential and important sectors to a high level. In the national context, that interrelationship is translated through the Wwke and the implementation of NIS2 within the broader cybersecurity architecture. The essential point is that these regimes jointly form a framework of governance and oversight in which digital resilience is not limited to cyber compliance, and in which physical or organizational resilience cannot be separated from the digital conditions under which essential services actually function. The relationship is therefore complementary, but its practical significance is substantially weightier than a simple division of tasks between separate statutes and supervisory regimes might suggest.
It follows that, for critical entities, organization-wide digital resilience cannot be approached either as an isolated implementation track for NIS2 obligations or as a separate cyber program alongside the broader resilience obligations under the CER and Wwke logic. The relevant administrative question is rather how the organization maintains its essential function under differing forms of disruption, and how digital dependencies, physical processes, supply-chain relationships, personnel measures, crisis structures, and notification obligations are aligned in such a way that no regulatory or operational fragmentation arises. A critical entity that reads the CER and the Wwke primarily as frameworks of physical or organizational robustness, and NIS2 solely as a cybersecurity obligation, runs the risk that its actual continuity architecture will splinter into disconnected parts. In such a case, risk analyses may remain too narrow, notification structures may operate in parallel, responsibilities may be diffusely allocated, and essential interfaces may remain unattended, for example where a cyber incident causes operational disruption, where a physical disturbance limits digital recovery possibilities, or where a supplier incident has both notifiable cyber impact and broader resilience consequences. The core of the new framework therefore lies in the integration of perspectives rather than in administratively parallel compliance.
This means that organization-wide digital resilience must be positioned, both legally and administratively, as the connecting layer between the different normative regimes. At the level of governance, this requires a coherent risk vocabulary, clear lines of accountability, integrated scenario analysis, aligned incident classification, and a consistent understanding of which processes, systems, and dependencies are truly critical to the essential service. At the level of implementation, it requires that cybersecurity measures, business continuity, crisis management, supplier management, physical security, notification obligations, and supervisory dialogues do not operate in isolation from one another. Precisely in critical entities, it must be prevented that formal compliance becomes a substitute for substantive resilience. The purpose of the combined CER, Wwke, and NIS2 framework is not the production of separate compliance outputs, but the strengthening of the actual capacity to maintain essential services under pressure. The true quality of organization-wide digital resilience is therefore revealed by the degree to which the entity succeeds in translating the normative coherence of these regimes into a single manageable model of continuity protection, with sufficient attention to dependencies, escalation, public responsibility, and demonstrable control.
Digital Resilience as an Integral Component of Integrated Financial Crime Risk Management in Critical Entities
Digital resilience must, within critical entities, be positioned as an integral component of Integrated Financial Crime Risk Management, because the boundary between digital disruption and loss of financial integrity in vital environments is becoming ever less sharply defined. While Integrated Financial Crime Risk Management has traditionally been strongly associated with money laundering risk, anti-corruption measures, sanctions compliance, fraud control, and the safeguarding of the integrity of transaction flows, present digital reality requires a broader reading. Impairment of financial integrity may disrupt the delivery of essential services, erode public trust, trigger supervisory intervention, and weaken the administrative legitimacy of the entity. Digital resilience thereby becomes, within Integrated Financial Crime Risk Management, not an additional theme, but a condition for the effectiveness of the integrity framework as a whole. Only where digital control, access management, detection capacity, supplier governance, recovery protocols, and financial integrity controls are designed in mutual coherence does a framework emerge within which critical entities are not only better able to withstand digital disruption, but are also able, under digital pressure, to preserve their integrity, accountability, and essential public function.
