Elas permitem a realiza\u00e7\u00e3o de projetos p\u00fablicos e de infraestrutura que, de outra forma, poderiam ser impedidos por obje\u00e7\u00f5es de propriet\u00e1rios ou vizinhos. A base constitucional da expropria\u00e7\u00e3o encontra-se no artigo 14 da Constitui\u00e7\u00e3o, desenvolvida na Lei de Expropria\u00e7\u00e3o (<em data-start=\"522\" data-end=\"539\">Onteigeningswet<\/em>) e no Decreto de Avalia\u00e7\u00e3o de Impacto Ambiental (<em data-start=\"589\" data-end=\"621\">Besluit milieueffectrapportage<\/em>), enquanto a obriga\u00e7\u00e3o de toler\u00e2ncia \u00e9 regulamentada por disposi\u00e7\u00f5es espec\u00edficas nos planos urban\u00edsticos e nas licen\u00e7as ambientais (notadamente pela Lei de Disposi\u00e7\u00f5es Gerais do Direito Ambiental \u2013 <em data-start=\"820\" data-end=\"860\">Wet algemene bepalingen omgevingsrecht<\/em>). No entanto, quando as partes envolvidas \u2014 desde munic\u00edpios at\u00e9 ag\u00eancias h\u00eddricas, desde incorporadoras at\u00e9 empresas de energia \u2014 ou seus \u00f3rg\u00e3os gestores e supervisores s\u00e3o acusados de m\u00e1 gest\u00e3o financeira, fraude, corrup\u00e7\u00e3o, lavagem de dinheiro ou viola\u00e7\u00e3o de san\u00e7\u00f5es internacionais, o Estado de direito e a execu\u00e7\u00e3o dos projetos ficam imediatamente comprometidos. Os atrasos em projetos de infraestrutura, medidas de saneamento ou zonas industriais geram n\u00e3o apenas consequ\u00eancias econ\u00f4micas, mas tamb\u00e9m ecol\u00f3gicas, pois os terrenos contaminados permanecem inutilizados e os investimentos necess\u00e1rios s\u00e3o paralisados.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-b91643e elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"b91643e\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-4dcb007\" data-id=\"4dcb007\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-078371e elementor-widget elementor-widget-text-editor\" data-id=\"078371e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4 class=\"\" data-start=\"1482\" data-end=\"1565\">M\u00e1 gest\u00e3o financeira em processos de expropria\u00e7\u00e3o e de obriga\u00e7\u00e3o de toler\u00e2ncia<\/h4><p class=\"\" data-start=\"1567\" data-end=\"2474\">Nos processos de expropria\u00e7\u00e3o, \u00e9 essencial uma avalia\u00e7\u00e3o rigorosa dos bens para determinar uma compensa\u00e7\u00e3o justa e cobrir poss\u00edveis penalidades ou custos de saneamento. A m\u00e1 gest\u00e3o financeira se manifesta, entre outras formas, em avalia\u00e7\u00f5es desatualizadas, or\u00e7amentos insuficientes para lit\u00edgios ou subestima\u00e7\u00e3o dos custos de descontamina\u00e7\u00e3o. Munic\u00edpios ou \u00f3rg\u00e3os p\u00fablicos que sistematicamente subestimam os or\u00e7amentos para despesas jur\u00eddicas ou an\u00e1lises de solo podem ser surpreendidos por encargos inesperados quando surgem muitos recursos. Isso retarda a execu\u00e7\u00e3o das expropria\u00e7\u00f5es, impede projetos ferrovi\u00e1rios ou el\u00e9tricos e exp\u00f5e \u00e1reas naturais sens\u00edveis a press\u00f5es ambientais prolongadas. Nessas situa\u00e7\u00f5es, investidores e empreiteiros frequentemente exigem garantias banc\u00e1rias adicionais e pr\u00eamios de risco, o que leva a uma escalada exponencial dos custos do projeto e \u00e0 perda de apoio da popula\u00e7\u00e3o.<\/p><h4 class=\"\" data-start=\"2476\" data-end=\"2525\">Fraude em avalia\u00e7\u00f5es e acordos de toler\u00e2ncia<\/h4><p class=\"\" data-start=\"2527\" data-end=\"3395\">A fraude nos processos de expropria\u00e7\u00e3o e de obriga\u00e7\u00e3o de toler\u00e2ncia manifesta-se principalmente na manipula\u00e7\u00e3o de dados cadastrais e na falsifica\u00e7\u00e3o de relat\u00f3rios ambientais ou do solo. Uma empresa de avalia\u00e7\u00e3o que, em conluio com um funcion\u00e1rio p\u00fablico, subavalia artificialmente o pre\u00e7o do terreno para reduzir a compensa\u00e7\u00e3o, ou uma consultoria que deliberadamente minimiza os n\u00edveis de contamina\u00e7\u00e3o para baixar os custos de saneamento, compromete o princ\u00edpio da seguran\u00e7a jur\u00eddica dos propriet\u00e1rios. Quando essas pr\u00e1ticas s\u00e3o reveladas, os processos j\u00e1 encerrados frequentemente s\u00e3o reabertos, novos recursos s\u00e3o interpostos e as decis\u00f5es de toler\u00e2ncia s\u00e3o anuladas. Isso provoca uma avalanche de pedidos de indeniza\u00e7\u00e3o e a necessidade de repetir os procedimentos de expropria\u00e7\u00e3o, acarretando um grande peso sobre os recursos p\u00fablicos e extensos prazos de execu\u00e7\u00e3o.<\/p><h4 class=\"\" data-start=\"3397\" data-end=\"3456\">Corrup\u00e7\u00e3o na expropria\u00e7\u00e3o e na obriga\u00e7\u00e3o de toler\u00e2ncia<\/h4><p class=\"\" data-start=\"3458\" data-end=\"4156\">A corrup\u00e7\u00e3o neste dom\u00ednio assume v\u00e1rias formas: um funcion\u00e1rio p\u00fablico que secretamente recebe \u201chonor\u00e1rios de consultoria\u201d em troca da imposi\u00e7\u00e3o ou suaviza\u00e7\u00e3o de uma obriga\u00e7\u00e3o de toler\u00e2ncia, ou um agente imobili\u00e1rio que envolve incorporadoras em esquemas corruptos para adquirir terrenos expropriados a pre\u00e7os artificialmente baixos. Tais pr\u00e1ticas n\u00e3o apenas levam a investiga\u00e7\u00f5es criminais, mas tamb\u00e9m invalidam os acordos de expropria\u00e7\u00e3o e de toler\u00e2ncia. O juiz administrativo pode decidir anular completamente as decis\u00f5es afetadas, for\u00e7ando as autoridades competentes a repetir as medidas, negocia\u00e7\u00f5es e indeniza\u00e7\u00f5es \u2014 causando anos de atrasos e desencorajando investimentos p\u00fablicos e privados.<\/p><h4 class=\"\" data-start=\"4158\" data-end=\"4218\">Lavagem de dinheiro por meio de transa\u00e7\u00f5es imobili\u00e1rias<\/h4><p class=\"\" data-start=\"4220\" data-end=\"5119\">As estruturas de lavagem de dinheiro frequentemente se revelam na compra e revenda repetida de terrenos antes do in\u00edcio dos processos de expropria\u00e7\u00e3o. Grupos criminosos criam empresas de fachada que, por meio de estruturas complexas, adquirem terrenos cujo uso \u201clegal\u201d serve como fachada para lavagem de capitais. Uma dilig\u00eancia insuficiente por parte dos munic\u00edpios ou um not\u00e1rio corrupto pode facilitar esse processo. Quando o <em data-start=\"4649\" data-end=\"4694\">Servi\u00e7o de Informa\u00e7\u00e3o e Investiga\u00e7\u00e3o Fiscal<\/em> (<em data-start=\"4696\" data-end=\"4739\">Fiscale Inlichtingen- en Opsporingsdienst<\/em> \u2013 FIOD) ou outras autoridades de controle financeiro detectam tais transa\u00e7\u00f5es suspeitas, os processos de expropria\u00e7\u00e3o e de toler\u00e2ncia em curso s\u00e3o imediatamente suspensos, os projetos s\u00e3o paralisados e as investiga\u00e7\u00f5es criminais podem se arrastar por anos. Os objetivos iniciais \u2014 como a expans\u00e3o de \u00e1reas naturais ou a constru\u00e7\u00e3o de linhas el\u00e9tricas \u2014 ficam assim comprometidos.<\/p><h4 class=\"\" data-start=\"5121\" data-end=\"5170\">Corrup\u00e7\u00e3o sist\u00eamica e conflitos de interesse<\/h4><p class=\"\" data-start=\"5172\" data-end=\"6085\">A corrup\u00e7\u00e3o no contexto da expropria\u00e7\u00e3o e da obriga\u00e7\u00e3o de toler\u00e2ncia vai al\u00e9m do simples suborno, refletindo uma cultura de favores e nepotismo pol\u00edtico. Isso se manifesta, por exemplo, na compra sistem\u00e1tica de apoio pol\u00edtico para a altera\u00e7\u00e3o de planos urban\u00edsticos ou no favorecimento cont\u00ednuo a determinados incorporadores por meio de pol\u00edticas condescendentes. Nesses sistemas, os controles independentes est\u00e3o ausentes: as auditorias internas s\u00e3o ignoradas, den\u00fancias de conflitos de interesse n\u00e3o s\u00e3o investigadas e vereadores votam contra suas pr\u00f3prias diretrizes. Quando uma situa\u00e7\u00e3o dessas vem \u00e0 tona, geralmente resulta em crises pol\u00edticas e mo\u00e7\u00f5es de desconfian\u00e7a. O Ministro do Interior pode ent\u00e3o intervir com base no artigo 46 da Constitui\u00e7\u00e3o, transferindo a compet\u00eancia sobre as expropria\u00e7\u00f5es e obriga\u00e7\u00f5es de toler\u00e2ncia para uma comiss\u00e3o estatal \u2014 com todas as consequ\u00eancias burocr\u00e1ticas associadas.<\/p><h4 class=\"\" data-start=\"6087\" data-end=\"6126\">Viola\u00e7\u00e3o de san\u00e7\u00f5es internacionais<\/h4><p class=\"\" data-start=\"6128\" data-end=\"6969\">Embora a expropria\u00e7\u00e3o e a obriga\u00e7\u00e3o de toler\u00e2ncia sejam, em sua ess\u00eancia, quest\u00f5es nacionais, san\u00e7\u00f5es internacionais podem entrar em jogo quando atores estrangeiros ou entidades sancionadas est\u00e3o envolvidos em projetos de desenvolvimento \u2014 por exemplo, parques e\u00f3licos mar\u00edtimos ou corredores de transporte transnacionais. A concess\u00e3o de direitos de uso ou a imposi\u00e7\u00e3o de obriga\u00e7\u00f5es de toler\u00e2ncia a empresas inclu\u00eddas em listas de san\u00e7\u00f5es pode levar ao bloqueio imediato de subs\u00eddios europeus, san\u00e7\u00f5es com base na legisla\u00e7\u00e3o internacional e congelamento de contratos em toda a Uni\u00e3o Europeia. Tais infra\u00e7\u00f5es n\u00e3o apenas comprometem projetos estrat\u00e9gicos nos setores energ\u00e9tico e de infraestrutura, mas tamb\u00e9m prejudicam a reputa\u00e7\u00e3o dos Pa\u00edses Baixos como parceiro de investimento confi\u00e1vel, dificultando futuras colabora\u00e7\u00f5es e financiamentos.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section
